Terms of Service
Please read these Terms of Service carefully before using PositivesConnect™. These terms form a legally binding agreement between you and PositivesConnect™ governing your use of the platform.
1. Acceptance of Terms
By creating an account on PositivesConnect™, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use PositivesConnect™. We reserve the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms. We will notify users of material changes via in-app notification or email.
2. Age Requirement & Eligibility
You must be at least 18 years of age to use PositivesConnect™. By registering, you represent and warrant that: • You are 18 years of age or older • You have the legal capacity to enter into a binding agreement • You are not prohibited from using dating or social platforms under applicable law • You have not been convicted of a felony or sex offense We reserve the right to terminate any account belonging to a minor immediately and without notice. We do not knowingly collect information from users under 18.
3. Account Responsibility
You are solely responsible for: • Keeping your login credentials confidential and secure • All activity that occurs under your account • Ensuring all information you provide is accurate, current, and complete • Notifying us immediately of any unauthorized access at security@positivesconnect.app You may not: • Share your account with another person • Create accounts for others • Create multiple accounts for the same person • Use another person's identity or account
4. Health Disclosure Disclaimer
PositivesConnect™ is a social connection platform. We do NOT: • Verify any health information disclosed by users • Conduct medical testing, certification, or screening • Provide medical advice or treatment • Guarantee the accuracy of any user-provided health information • Assume responsibility for your sexual health decisions All health disclosures on PositivesConnect™ are entirely self-reported by users. You assume full personal responsibility for: • The accuracy of your own disclosures • Understanding and communicating your health status • Your sexual health decisions and practices Always practice informed consent and consult a qualified healthcare provider for medical guidance.
5. Prohibited Conduct
You agree not to: • Create a fake, misleading, or impersonating profile • Harass, threaten, stalk, or intimidate other users • Post content that is illegal, defamatory, obscene, or violates any person's rights • Distribute non-consensual intimate images (revenge porn) • Use the platform if you are under 18 • Attempt to reverse-engineer, hack, or disrupt the platform • Spam or send unsolicited commercial messages • Solicit money or financial assistance from other users • Share another user's personal or private information without consent • Use automated bots, scrapers, or software to interact with the platform • Engage in sex trafficking, solicitation, or any illegal sexual conduct Violations may result in immediate account termination and, where applicable, referral to law enforcement.
6. Content Ownership & License
You retain full ownership of the content you submit (photos, videos, messages, and profile information). By submitting content to PositivesConnect™, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to: • Store, display, and transmit your content for platform operation • Use anonymized content for safety and moderation This license ends when you delete your content or your account. You represent that: • You own or have rights to all content you submit • Your content does not violate any third-party rights • You have consent of all persons depicted in photos or videos
7. Premium Subscriptions & Payments
SUBSCRIPTION AUTO-RENEWAL DISCLOSURE: PositivesConnect™ Premium subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. Your chosen payment method will be charged at the applicable rate. Billing & Cancellation: • You can cancel at any time before your renewal date to avoid being charged • Cancellation takes effect at the end of the current billing period — you retain access until then • No refunds are issued for the current billing period once charged • For Apple App Store purchases: manage subscriptions in iOS Settings → Apple ID → Subscriptions • For Google Play purchases: manage in Google Play → Account → Subscriptions • For direct billing: cancel at any time via Account Settings in the app Payment processing is handled by Stripe, PayPal, Apple In-App Purchase, or Google Play Billing. We do not store payment card numbers.

PositivesConnect™ and its original content, features, functionality, design, and source code are the exclusive property of PositivesConnect™ and its licensors, protected by United States and international copyright, trademark, and other intellectual property laws. You may not: • Copy, modify, or distribute our platform's design, code, or content • Use our trademarks, logos, or brand elements without written permission • Create derivative works based on PositivesConnect™ If you believe any content on our platform infringes your intellectual property, contact legal@positivesconnect.app.
9. Reporting, Moderation & Termination
We encourage users to report inappropriate behavior, fake profiles, or policy violations using the in-app reporting tools. We review all reports and reserve the right to: • Remove any content that violates these Terms without prior notice • Suspend or permanently terminate accounts for violations • Cooperate with law enforcement investigations when legally required • Decline to explain termination decisions where doing so would compromise safety or legal proceedings We are not obligated to monitor all content but will act on reported violations in good faith.
10. Disclaimer of Warranties
PositivesConnect™ is provided 'as is' and 'as available' without warranties of any kind, either express or implied. We do not warrant that: • The platform will be uninterrupted, error-free, or secure • Any information obtained through the platform will be accurate or reliable • Defects will be corrected • The platform is free from viruses or other harmful components Your use of the platform is entirely at your own risk.
11. Limitation of Liability
To the maximum extent permitted by applicable law, PositivesConnect™ and its officers, directors, employees, and agents shall not be liable for: • Any indirect, incidental, special, punitive, or consequential damages • Loss of data, revenue, goodwill, or profits • Damages resulting from the actions or content of other users • Any interruptions, errors, or security breaches • Reliance on health disclosures made by other users In no event shall our total liability exceed the greater of $100 USD or the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless PositivesConnect™, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: • Your use of the platform • Your violation of these Terms • Your violation of any applicable law or third-party right • Content you submit to the platform
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States without regard to conflict of law provisions. Dispute Resolution: Any disputes arising from these Terms or your use of PositivesConnect™ shall first be attempted to be resolved informally by contacting legal@positivesconnect.app. If informal resolution fails: • U.S. users: disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules • EU users: you may be entitled to use alternative dispute resolution (ADR) under applicable EU consumer law • Nothing in these Terms limits your statutory consumer rights under applicable law
14. App Store Compliance
If you download PositivesConnect™ through the Apple App Store or Google Play Store: • These Terms are between you and PositivesConnect™, not Apple or Google • Apple and Google are not responsible for the platform or any claims arising from your use • Apple has no obligation to provide support for PositivesConnect™ • You must comply with applicable third-party terms of service when using the platform
